THIS AGREEMENT made this _______ day of ___________________________ ,20______ ,by and between All Seasons Home Inspections (hereinafter called the "Company") and ____________________ (hereinafter called the "Client").
 
1.       Client requests a limited visual inspection and written report of the subject property indicated above by Company. The inspection will be performed in accordance with the current Standards of Practice of the American Society of Home Inspectors, Inc. (ASHI); a copy has been provided and/or is available at: http://www.ashi.org/inspectors/standards/standards.asp, prior to signing this agreement. Client understands that these standards contain certain limitations, exceptions and exclusions. The ASHI Standards are hereby incorporated by reference in their entirety and are made part of this Agreement. Should Company exceed standards in one area, Company shall not be obligated to exceed the standards in other areas.

2.       The purpose of this inspection in accordance with the ASHI Standards of Practice is to identify and disclose systems and components inspected which, in the professional opinion of the inspector, are significantly deficient or are near the end of their service lives at the time of the inspection and provide a written report of such. Inspector may offer comments, but these comments will not comprise the bargained-for report. Detached buildings are not included unless otherwise specified.

3.       This inspection, and the report issued, of which this Agreement will be incorporated by reference and made part thereof, is not intended to be technically exhaustive nor is it considered to be a GUARANTEE OR WARRANTY, EXPRESSED OR IMPLIED, REGARDING THE CONDITIONS OF THE PROPERTY, ITEMS AND SYSTEMS INSPECTED AND IT SHOULD NOT BE RELIED ON AS SUCH. Client understands and agrees that Company reserves the right to modify the inspection report for a period of time that shall not exceed forty eight (48) hours after the inspection report has first been delivered to Client.

4.       This inspection and report are performed and prepared for the sole confidential and exclusive use and possession of the Client. The report or any part thereof is not intended for any persons other than Client. The report or any part thereof is non-transferable. Client agrees to indemnify, defend and hold the Company harmless from any third party claims or actions relating to this inspection or inspection report.

5.       The inspection and report do not address and are not intended to address the possible presence of, or danger from mold & mildew, asbestos, radon gas, lead paint, urea formaldehyde, soil contamination and other indoor and outdoor pollutants, toxic or flammable chemicals, water or airborne related illness or disease, and all other similar or potentially harmful substances and conditions. However, a radon air test may be performed as part of this inspection if specifically ordered and paid for by the Client. In addition, the presence or absence of wood destroying insects, and septic system evaluation are also not part of this inspection.

6.       The inspection service is conducted at the property. Client is encouraged to attend. The physical on­site inspection of the property is a valuable time of exchange of information between Client and Company. Any concern(s) of Client must be brought to the attention of Company, in writing, before the inspection begins. If Client attendance is not possible, this Agreement will become part of the report. If any part of the report is not fully understood, Client shall contact Company. There is no additional fee for this service.

7.       In the case of a discrepancy, dispute or claim arising from the performance of an inspection by the Company, the Client agrees to promptly notify the Company in writing within 14 days of discovery, specifying the basis for the alleged discrepancy, dispute or claim. Client agrees to allow the company access to the property to examine any subject matter of any claim prior to Client's performance of any remedial action (unless of an emergency nature and/or for the safety of persons or property). Client's failure to do so will violate this agreement and release Company from any alleged discrepancy, dispute or claim. Any action to recover damages for any act or omission of Company must be commenced not later than 1 year from the date of the Inspection as indicated on the inspection report. Such action must be commenced in a court in the County and State in which the Company has its principle place of business.

8.       If any court declares any provision of this Agreement invalid or unenforceable, the remaining provisions will remain in effect. This Agreement represents the entire agreement between the parties. All prior communications are merged into this agreement, and there are no terms or conditions other than those set forth herein. No statement or promise by the Company shall be binding unless reduced to writing and signed by the parties.

9.       Client agrees to read the entire inspection report and any lab results, if applicable. Client should also read the owner's property disclosure as owner may be aware of occasional or seasonal issues such as, but not limited to roof or basement leakage. Client further agrees to follow the recommendations in the report for further evaluation, service or repair prior to legal and/or financial commitment. Client's failure to do so will violate this agreement and release Company from any alleged discrepancy, dispute or claim. Client assumes responsibility for areas that are not readily accessible as per ASHI Standards of Practice. It is recommended that client do a preclosing inspection.
 
The undersigned have read this agreement, and understand and accept the terms and conditions of this agreement which includes the ASHI Standards of Practice, and agree to pay the specified fee below. Client acknowledges receipt of a copy of this Agreement.
